End User License Agreement
Effective 18 July 2026
This End User License Agreement ("Agreement") is a legal agreement between you and Apalim Studios governing your use of the TinyYears mobile game and related services, updates and content (the "App"). By downloading, installing or using the App, you agree to this Agreement. If you do not agree, do not use the App. If you are under the age of majority where you live, you confirm that your parent or guardian has agreed to this Agreement on your behalf. The App is rated for players aged 12 and over.
1. Licence
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use one copy of the App on devices you own or control, for your own private, non-commercial entertainment, subject to this Agreement and the rules of the app store you obtained it from.
2. Restrictions
Except where the law permits, you must not: (a) copy, sell, rent, sub-licence or commercially distribute the App; (b) reverse engineer, decompile or extract its source code or assets; (c) tamper with or circumvent any security, licensing or purchase mechanism; (d) use cheats, automation or exploits that harm other players or our systems; or (e) use the App unlawfully or in breach of any third party's rights.
3. Player-created content
The App lets you create characters and enter names and other text ("Your Content"), and it may generate names and characters automatically. You are solely responsible for Your Content. You must not create content that impersonates, defames or harasses a real person; that is hateful, discriminatory, obscene or otherwise objectionable; or that infringes anyone’s intellectual property, privacy or publicity rights. We provide an automated filter for offensive names and language, but we do not pre-screen all content and are not responsible for content you create. We may remove content or restrict access that breaches this Agreement.
4. Characters are fictional
All characters, names, places and events in the App are fictional. Names may be randomly generated and characters may be created by players. Any resemblance to real persons, living or dead, or to actual events, is entirely coincidental and unintended. Player-created content represents the player, not Apalim Studios.
5. Intellectual property
The App and all associated content, artwork, code, the TinyYears name and logo, and the "Lifer" engine and branding are owned by us or our licensors and are protected by intellectual-property laws. Certain assets are used under third-party licences (for example, the "Playtopia" typeface is licensed via Envato Elements). Nothing in this Agreement transfers any ownership to you.
6. Purchases and virtual items
Any in-app purchases, virtual currency or virtual items are licensed, not sold, have no monetary value, cannot be exchanged for real money, and may be changed or discontinued. Purchases are processed by the relevant app store under its terms; refunds are handled by that store.
7. Updates
We may update, change or discontinue the App or any feature at any time, with or without notice. Some updates may be required for the App to keep working.
8. Disclaimer of warranties
To the fullest extent permitted by law, the App is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted, error-free or secure. Nothing in this Agreement excludes liability that cannot be excluded by law (including for death or personal injury caused by negligence, or for fraud).
9. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or loss of data, profit or goodwill, arising from your use of the App. Where liability cannot be excluded, our total liability is limited to the amount you paid for the App (if any) in the 12 months before the claim. This does not affect your statutory rights as a consumer.
10. Termination
This licence ends automatically if you breach this Agreement. On termination you must stop using and delete the App. Sections that by their nature should survive (including 3 to 5, 8, 9 and 12) continue to apply.
11. Privacy
Our use of your data is described in our Privacy Policy, available on our website and store listing. The App uses Firebase for crash reporting and anonymous, aggregate usage analytics.
12. Governing law
This Agreement and any dispute arising from it are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that if you are a consumer you may also have the benefit of mandatory protections and the courts of your country of residence.
13. Changes to this Agreement
We may update this Agreement. If we make material changes we will provide reasonable notice (for example, in-app or on our website). Continued use after changes take effect means you accept the updated Agreement.
14. Apple App Store additional terms
If you obtained the App from the Apple App Store, the following apply and prevail for that copy in case of conflict: this Agreement is between you and Apalim Studios only, not Apple, and Apple is not responsible for the App or its content; your licence is limited to Apple-branded devices you own or control as permitted by the App Store Terms of Service; Apple has no obligation to provide maintenance or support; Apple has no warranty obligation, and any warranty, product-liability, legal or regulatory claims are our responsibility, not Apple’s; Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it; and you confirm you are not located in an embargoed country or on a restricted parties list.
